As a new year begins, it is time to put away the holiday decorations and prepare for testing calendar year 401(k) plans. It is too late to change the HCE group or current/prior year testing method so you must look at other options. This fast paced, interactive webcast will review the testing techniques of disaggregation, shifting, recharacterization and the use of QNECs and QMACs. Examples of each will be given. Our clients expect us to be creative and this webcast will expand the options you have for testing. This is a perfect time of year to either be introduced or receive a refresher on these options.

The Department of Labor (DOL) appears to be targeting for investigation broker-dealers and financial advisory firms which service ERISA retirement plans. Their focus is on the identification of improper or undisclosed compensation received by these firms. This webcast will explore: what the DOL is looking for; how the DOL is approaching the investigation process; possible steps which all firms can take in an effort to protect themselves; and how a firm can survive an investigation upon becoming a target.

Who is the qualified plan beneficiary? What are the beneficiary’s distribution options? These are two questions whose answers are affected by more than one source. The final Required Minimum Distribution rules, the plan document options and the beneficiary designation form as well as the ERISA definition of beneficiary all may impact the answers. This session will present the rules, regulations, beneficiary designation terms/issues and the plan document options and the impact of each of these. There will also be many real-world examples, including handling various beneficiary payment scenarios such as payment to a minor and more.

Plan administrators of participant directed individual account plans will be subject to the new participant disclosure regulations as early as November 1, 2011. This session will cover the new rules as well as the detailed information that must be provided about the plan and its designated investment alternatives. Also to be discussed are the consequences of non-compliance, special target date disclosures, ERISA §404(c) concerns, practical issues and potential problems implementing these requirements, as well as effective date issues.

This webcast will differentiate between tax-free transfers and exchanges of 403(b) accounts, and rollovers into 403(b) and 457(b) plans. The speakers will provide detailed information about the rules and the practical aspects of assisting IRA owners and participants in 403(b) and 457(b) plans in repositioning and/or consolidating other retirement savings based on the requirements set forth in the written plans.

Six states (Massachusetts, Connecticut, Iowa, Vermont, New Hampshire and New York) and the District of Columbia now permit same-sex couples to marry. In addition, California recognizes the 18,000+ same-sex marriages that took place between June 17, 2008 and November 4, 2008. Further, many states recognize either domestic partnerships or civil unions. Employers that have employees in any of the states are now left to decide what – if any - benefits to provide to their employee’s domestic partners or same-sex spouses (and how to determine who is a domestic partner or a same-sex spouse of any employee). Join Ronald J. Triche as he discusses the status of domestic partnerships, civil unions and same-sex marriages in the United States and other countries and the decisions employers need to make regarding the provision of employee benefits to the domestic partners and same-sex spouses of their employees.

This session will be structured as a frank discussion of issues of interest to retirement plan professionals with the Director of Employee Plans Examinations from the Internal Revenue Service. It is expected to include updates on (i) current IRS audit initiatives; (ii) what the IRS learned from its 401(k) questionnaire; (iii) the successes, problems, and future of the ERPA Program; and (iv) a dialogue with attendees about the impact of the PTIN Program and Circular 230 on retirement plan professionals in light of the exemption of Form 5500 return preparers from registration. Even as we finish amending defined benefit plans for EGTRRA, we must now start amending pre-approved Defined Contribution Plans for the PPA restatement cycle. The IRS has finally issued the long anticipated guidance on what the rules are for this next cycle for pre-approved plans. They also issued updated LRMs with suggested plan language.
